Does this step fit you?

Who is the training for?

Experienced lawyers, law firms and specialists for demanding money laundering mandates.

What prior knowledge do you need?

In-depth knowledge of client testing and experience with complete case files; a safe handling of legal sources is required.

Your concrete added value

You train a technical justification that also withstands critical questions. The focus is on difficult transitions between areas of activity and information contexts, which cannot be convincingly processed with a mere yes-no selection.

Complex case assessment · Assess ambiguous engagements methodically

That's what you're working on in this training.

  1. Distinguishing Mandates

You examine an order that combines legal advice, a possible process representation and participation in a transaction. For each information, you determine when and in what context it was obtained and which classification depends on it.

  2. Check exceptions and counter-arguments

You work on the wording of the professional AMLR regulations and compare the German starting position. A first convincing argument is specifically confronted with a counterposition. The exercise requires explicitly to specify the conditions and limits of any claimed exception.

  3. Jurisdiction and uncertainty

You develop a targeted search question and examine appropriate official decisions, as far as they are available for the case constellation. In doing so, you distinguish their actual subject from the desired transfer to the future AMLR framework and mark open legal issues.

Your learning goals

  • To analyse multi-part mandates and information sources separately.
  • To examine exceptions without a flat-rate reference to confidentiality.
  • Consider counter-arguments and differences in the comparative case.
  • To formulate a reasoned position with remaining uncertainties.

From knowledge to a well-founded case solution.

Advising on the dispute and subsequent capital transfer

A client has an assessment of a corporate dispute and then asks for participation in a capital transfer. A new document calls into question his previous statement. You will investigate changes of activity, information context and possible ways of action without premature determination.

In focus: Limits of occupational exceptions and source-based assessment.

Your Exercise

Make a balance note on two possible classifications. Show what additional fact would change the evaluation and name a search route for the remaining legal question. Then you defend your position in the technical discussion.

Your work result and proof of participation

A differentiated note with sources, counter-arguments, clarification requirements and a comprehensible preliminary conclusion.

How this relates to your daily work

You strengthen the ability to represent difficult cases vis-à-vis partners or internal auditors in an understandable manner. At the same time, you learn to openly document technical uncertainty and to work on it.

Planned: 5 hours of training. With space for application.

The planned pure training time is 300 minutes. It includes knowledge transfer, application at the practice case and joint evaluation. Breaks are added. The data are planning values; we coordinate the concrete process before the training.

Voluntary additional option · planned +60 minutes

You decide if you're going to take an additional exam.

Training is also possible without additional final examination. After completing your training you will receive a certificate of participation and a badge of participation. A proof of passing an examination requires successful participation in the voluntary supplementary examination.

Test format

Optional performance test: written, complex case examination and technical meeting.

Your exam task

Prove your solution, present the strongest counterposition and explain the significance of your sources. The quality of argumentation and comprehensible examination are evaluated; an unresolved clear statement does not replace derivation.

This is what the evaluation depends on.

  • Derogation requirements checked precisely
  • Counter-arguments seriously appreciated
  • Sources and uncertainties transparent

Documentation of the test performance

After completing the training, you receive a participation certificate and a participation Badge for level 5. Passing the optional assessment is additionally documented by an assessment certificate.

Participation and examination performance remain recognizable.

The personal proof explicitly indicates whether the participation or a passed voluntary supplementary examination is confirmed. The badge graphic shows the industry and level of learning; it is not in itself a proof of performance.
