Your concrete added value
That's what you're working on in this training.
Insulate the decisive demarcation You break a mixed advisory and transaction mandate into concrete activities and information strands. In doing so, you determine the decisive facts, examine the appropriate facts and avoid treating different mandate phases equally. Recognizing sources and counterpositions You work with original standards, relevant board notes and available court decisions. For each of the statements made, you will examine the facts, legal status and scope; a lack of relevant case law and unsustainable transfers will be explicitly identified. Establishing a justifiable position You compare two possible assessments and check their consequences for the specific law firm process. The final assessment combines source evidence, factual assumptions and remaining uncertainty with a well-founded recommendation for further technical work.
Your learning goals
Mixed mandate parts and information streams differentiated. Case law to be examined on the basis of facts and legal status for transferability. Explicitly weigh arguments against your own assessment. Precisely specify the need for clarification and the limits of a provisional recommendation.
From knowledge to a well-founded case solution.
